Terms & Conditions

“Kalout’ s International Tours’ Terms and Conditions”

Booking Conditions:
To make a booking, you can contact us in three ways: by telephone, via our website, or through a partner travel agent. The person making the booking (the ‘lead name’) must be over 18 years old, and possess the legal capacity and authority to make the booking, and accept the booking conditions on behalf of everyone in their party.
Payment Terms:

a)    For cultural and expedition tours:
 
•    10% of the total invoice is to be paid, as a deposit, immediately on confirmation of services, which is non-refundable.
•    20% of the total invoice is to be paid at least 90 days prior to the arrival.
•    20% of the total invoice is to be paid at least 75 days prior to the arrival.
•    The rest 50 % of the total invoice must be paid at least 56 days prior to the date of arrival.

*Clearly, if you book less than 56 days before the arrival, you will need to pay the whole invoice on booking.

b)    For camping tours:

•    10% of the total invoice is to be paid, as a deposit, immediately on confirmation of services, which is non-refundable.
•    40% of the total invoice is to be paid at least 55 days prior to the arrival.
•    The rest 50% of the total invoice must be paid at least 40 days prior to the date of arrival.

*Clearly, if you book less than 40 days before the arrival, you will need to pay the whole invoice on booking.

Booking Cancellation Terms:

a)    For cultural and expedition tours:

•    For the cancellations received 30 days or less prior to the arrival, none of the total invoice will be refundable.
•    For the cancellations received 40-31 days prior to the arrival, 25% of the total invoice will be refundable.
•    For the cancellations received 55-41 days prior to the arrival, 50% of the total invoice will be refundable.
•    For the cancellations received 56 days or more prior to the arrival, 90% of the total invoice will be refundable. (As the first 10% deposit is non-refundable.)

b)    For camping tours:

•    For the cancellations received 25 days or less prior to the arrival, none of the total invoice will be refundable.
•    For the cancellations received 26-29 days prior to the arrival, 50% of the total invoice will be refundable.
•    For the cancellations received 30 days or more prior to the arrival, 90% of the total invoice will be refundable. (As the first 10% deposit is non-refundable.)


Currency:
You can pay in any currencies: dollars, pounds, euros, …


Confirmation Invoice and Contract Signing:
If we accept your booking, we will issue a Confirmation Invoice. A contract will be signed between us from the date we issue the Confirmation Invoice. When you receive the Confirmation Invoice please check the details carefully and inform us immediately if anything is incorrect. Names on travel documents must exactly match those in your passports. Unless we are responsible for the mistake, we will not accept liability if an airline or other supplier refuses boarding because the name(s) shown in your passport differ from those on your ticket.
Upon your confirming the validity of the information included in the Confirmation Invoice, a contract will be signed between us. This contract can be prepared, manually or electronically by the traveler or the lead, with the confirmation of the agency, via the dedicated website. It also can be bought through electronic payment of printed services in this contract for the participants.
Travel documents- including the copy of your contract, the copy of the signed Booking Terms and Conditions, and the copy of the signed invoice- will be sent or emailed to you approximately 2 weeks before your departure, and will not be issued unless payment of the due balance has been received.
*We cannot accept any liability for tickets lost in the post.

Booking amendments or Cancellation by the traveler:
•    If you decide to cancel some items included in the contract, Booking Cancellation Terms will apply. It must be mentioned that cancellation will only be effective when we receive a written application letter for cancellation from the traveler or the lead.
•    If you wish to transfer from one trip to another, or transfer your booking to a third-party you must notify us at least 57 days prior to the proposed arrival date.  A fee of $150 per person will apply (in addition to any charges levied by hotels, ground operators or airlines).  If you notify us less than 57 days prior to the proposed arrival date, Booking Cancellation Terms will apply. Transfers to a third-party are only permitted if the transferee meets all the requirements in relation to the trip and confirms and signs the Booking Terms and Conditions.

Cancellation by Kalout:
We may cancel a trip at any time prior to departure if due to terrorism threat, natural disasters, political instability or any other unexpected events, it is not logical for us to operate the planned itinerary. In this case, you can transfer amounts paid to an alternate departure date, or alternatively receive a full refund.
*In this case, the agent will be obliged to inform the travelers, 48 hours before the departure date.

Also, in case the number of travelers doesn’t reach the minimum standard capacity of the tour, the agency will be allowed to terminate the contract, and pay the travelers a refund, unless a supplement fee is charged, to compensate for the number of travelers. It will be up to the travelers which choice to make - the termination of the contract or paying the extra fee.

Prices & surcharging:
All prices we advertise are accurate at the date published, but we may change them after the validity period mentioned. So, prices on our website are updated regularly. Before you make a booking we will give you the up-to-date price of your chosen arrival date including any tour supplements, upgrades or additional facilities which you have requested.
* Although the cost of the tour for the agency may be influenced by a variety of factors such as the cost of fuel, dues, taxes or fees chargeable for services, due to the fluctuations in the exchange rate, we may not charge you more than what we have decided on at the time you had booked, and no surcharging will be involved in this regard.
*You may be required to pay for any unexpected costs, which we are not responsible for and are not included in the contract, e.g. if in case of emergency like a natural disaster or the closing of the road, we are forced to stay at the hotel longer or replace a road transfer with an air one, the traveler will be charged for the extra inevitable costs.

Inevitable Delay or Change in the tour’s arrangements or Itinerary:
Throughout the trip there are possibilities of delay or putting forward the meals, resting, sleeping times, changes in transportation distances in the day or at night while riding or trekking, due to the unexpected climate changes- locally, environmentally or incidentally.

Visa Issue:
Out of his/her best effort & cooperation, the agency will try to get the Visa reference number of the passengers, upon not issuing of which there would be no responsibility on him/her. In such a case, the agency will not charge you at all, and you will only have to pay the visa application fees to the embassy.
  accommodation:
In the case of residing in hotel, the price of each trip is adjusted on the basis of double-room accommodation and solo travelers will go under the regulations & fees of single-room accommodations.

Check-in will be at 2 P.M, and check out at12:00.

Regarding local accommodations or open air stay (camp, cottage, local and furnished local houses), accommodation conditions will be based on the criteria of accommodation installations, under the confirmation of Iran’s Cultural Heritage, Handicrafts and Tourism organization. With low possibility of staying in a single room, the needed time for camping & packing would depend on the travelers. It must be mentioned that the availability of a private room in local houses depends on the number of travelers and the number of rooms available. Of course, on camping trips we can offer you private tents. Besides, private accommodation is not included in our itineraries and if you apply for it as a supplement, if possible, you will need to pay for the supplementary service.

Traveler’s commitments:
-The traveler or the lead undertakes the responsibility to provide his companions’ and his own personal specifications completely and accurately for booking, and especially for issuing the visa.
It is clear that the traveler & the representative will be responsible for any contradictions in travelers’ registration information, over which the agency takes no responsibility.

-Since we believe in responsible tourism, the passenger is expected to follow the orders of the tour guide, and to respect and observe all the host’s customs, regulations, and norms. Especially on nature tours, it is crucial to respect and obey the tour guide in order to ensure the safety of everybody on the tour and respecting their rights.

-All throughout the trip, the traveler will undertake the whole responsibility of any expenses & losses- out of disobeying the tour guide, the excursions out of the broker’s services, or not carrying any necessary personal tools mentioned in the itinerary.
 
- Ensuring the transfer of the equipment from the accommodation to the means of transportation, while leaving the residence/region, is the traveler’s responsibility.

-Throughout the trip, the traveler will be responsible for looking after his/her children, properties and personal documents, over which the guide & broker take no responsibility.

-The traveler or the lead should buy tours whose hardness grade is in accordance with their physical capability, and in the case of being under any specific medication, or needing any medical equipment, the travelers themselves are obliged to provide and carry them, and they must inform the agency and the tour guide as well.
*Your personal safety is a priority to us; therefore, it is crucial that you inform us, at the time of booking, of any medical condition, or physical or mental disabilities, that might affect your or other people’s enjoyment of the trip. Otherwise, the traveler is responsible for any problems caused by the lack of physical preparation or being aware of their own physical condition, or any other potential problems throughout the trip.
-The traveler insurance will be valid only for the time and places mentioned in the itinerary. If the traveler separates from the group, the agency won’t take his/her responsibility any more.

-The traveler acknowledges that the nature of eco- tours is adventurous and may involve a significant amount of risk to their health and/or safety. The traveler hereby assumes all such risk and does release the agency from all claims and causes of action arising from any damages or injuries resulting from these risks inherent in travel, visiting foreign destinations, and participating in adventurous activities such as those included in the agency’s itineraries.
- The traveler is obliged to carry his/her passport, identification card, his/her international and domestic plane/train tickets, and his/her trip contract all through the trip.
The Agency’s commitments:

-The agency is obliged to provide all fees and services in the invoice or on the website.

-The agency is obliged to offer all the agreed services completely.
-On land trips, if the means of transportation is broken for any reason, the price of replacing it with another one, or any other expenses due to that delay is to be paid by the agency. The traveler will be informed about the time needed for providing a new vehicle & the length of the delay.

*In the case of any delay in Land (road and rail), air or water transportation, the related official rules will be acted upon.
 
-The agency is obliged to use the best transportation means based on the trip route (gravel or asphalted), the number of travelers & the excursion path.
 
-The agency is obliged to cover the travelers under an Insurance of Civil Liability.

-All trips, should be accompanied by an escorting confirmed guide of Cultural Heritage, Handicraft, & Tourism organization or a local guide.
 
- The agency is obliged to equip the tour with a first aid kit.
 
- The agent is obliged to be in co-ordination with the office of National and Foreign Travelers Affairs & to get the NAJA Code of foreign travelers, to ensure the traveler’s safety during the trip.

FORCE MAJEURE
Kalout will not be responsible in any way about the traveler for death, physical injury, illness, damage, delay or other loss or detriment to person or property, or financial costs, or for Kalout’ s failure to perform and/ or complete any duty owed to the traveler if such problem is caused by natural disasters, mechanical breakdowns, terrorist threat , civil commotions, labor difficulties, interference by authorities, political disturbance, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of Kalout; or an event which Kalout or the supplier of services, even with all due care, could not foresee.
 
CLAIMS AND COMPLAINTS
The traveler agrees to bring any complaints regarding received services, as soon as possible, in order to provide Kalout with the opportunity to address such complaint properly.
